Booking Terms & Conditions
The terms that govern every inspection URBYN performs.
1Acceptance of these Terms
These Terms & Conditions govern all vehicle inspection services provided by URBYN (Pty) Ltd ("URBYN", "we", "our" or "us").
By booking an inspection through our website, paying for a service or otherwise engaging URBYN, you confirm that you have read, understood and agree to these Terms & Conditions, our Privacy Policy and any other policies published by URBYN.
These Terms are governed by the laws of the Republic of South Africa, including, where applicable, the Consumer Protection Act, 2008 ("CPA") and the Protection of Personal Information Act, 2013 ("POPIA").
2Booking Confirmation
Bookings are made through URBYN's online booking platform.
A booking is only confirmed once:
- •Full payment has been successfully received.
- •URBYN has acknowledged the booking.
- •A mutually agreed inspection appointment has been arranged with the seller, dealership or lawful custodian of the vehicle.
Submitting a booking request does not guarantee an inspection until these requirements have been met.
3Payment
Full payment is required in advance to secure an inspection booking.
Payments are processed through a secure third-party payment provider selected by URBYN. URBYN does not store customers' complete payment card details.
Failure of payment may result in cancellation of the booking.
4Arranging the Inspection
Following confirmation of payment, URBYN will contact the seller or vehicle custodian to arrange an inspection.
Customers acknowledge that inspection appointments depend on the cooperation and availability of the seller or dealership.
URBYN cannot guarantee appointment times until arrangements have been confirmed.
5Cancellations and Rescheduling
Customers may request changes to an inspection appointment.
URBYN will facilitate up to two (2) mutually agreed inspection appointments with the seller.
Where an inspection cannot proceed after two agreed appointments due to the seller's unavailability, cancellation or failure to present the vehicle, URBYN may cancel the booking and issue a 50% refund.
This policy reflects that both URBYN and the customer have incurred time, administrative costs and scheduling commitments.
If a customer cancels before URBYN has commenced arranging the inspection, a full refund may be issued.
Where URBYN has already commenced arranging the inspection but the inspection has not yet taken place, URBYN reserves the right to deduct a reasonable administration fee before processing any refund.
6Scope of Inspection
URBYN inspections are conducted in accordance with the published URBYN Principles, which define our inspection methodology, ethics, standards and operating procedures. These Principles may evolve as our knowledge, technology and inspection methods develop.
Unless otherwise agreed in writing, inspections are:
- •Visual and functional in nature.
- •Non-destructive.
- •Conducted without specialist dismantling.
- •Based on the vehicle's observable condition at the time of inspection.
Inspectors may lift floor mats, open compartments, remove loose covers, operate removable panels and perform other non-destructive checks that can reasonably be carried out by hand without tools.
URBYN will not dismantle components requiring tools or undertake repairs during an inspection.
7Inspection Limitations
URBYN inspections are not:
- •Mechanical warranties.
- •Guarantees of future reliability.
- •Roadworthy certificates.
- •Insurance assessments.
- •Manufacturer-approved inspections.
- •Guarantees that every fault will be identified.
Hidden, intermittent or developing faults may not be detectable during a visual inspection.
8Seller Cooperation
Inspection quality depends upon reasonable access being provided to the vehicle.
Where access is restricted or refused, URBYN will complete the inspection as far as reasonably possible.
Restrictions may include, but are not limited to:
- •Refusal of a test drive.
- •Restricted engine access.
- •Refusal of diagnostic scanning.
- •Restrictions on photography.
- •Inaccessible areas.
- •Vehicle not presented in a suitable condition.
Any such restrictions will be recorded within the inspection report.
URBYN accepts no responsibility for matters that could not reasonably be assessed due to these limitations.
9Test Drives
URBYN will ordinarily conduct a road test as part of the inspection.
The route, duration and distance of the road test remain entirely at the inspector's discretion, taking into account safety, legality, traffic conditions and the suitability of the vehicle.
For vehicles valued at approximately R2 million or more, or where an inspector reasonably determines that a road test is inappropriate, unnecessary or presents an unacceptable risk, the road test may be omitted. Any such decision will be recorded in the inspection report.
Responsibility for maintaining lawful motor vehicle insurance remains with the vehicle owner or lawful custodian.
10Diagnostic Scanning
Where available and appropriate, URBYN may perform electronic diagnostic scans.
If a diagnostic scan cannot be completed due to incompatibility, aftermarket modifications, seller refusal, technical limitations or equipment failure, this will be recorded in the report.
Diagnostic scanning uses industry-standard communication protocols. While generally regarded as safe, URBYN cannot guarantee compatibility with every vehicle or aftermarket modification.
URBYN accepts no liability for electronic faults, warning lights, software anomalies or component failures alleged to arise from a diagnostic scan unless caused by proven negligence.
Where reasonably necessary to complete an inspection, URBYN may clear diagnostic fault codes for the sole purpose of determining whether faults reoccur during testing. The customer and/or seller acknowledges that this forms part of the inspection process. Any fault codes present before and after testing may be recorded in the inspection report where practical.
11Weather
URBYN reserves the right to postpone or reschedule inspections where weather or environmental conditions may materially affect the quality, safety or accuracy of the inspection.
This includes heavy rain, flooding, severe storms or any other conditions that may reasonably impair inspection quality.
12Report Preparation
URBYN aims to deliver inspection reports as soon as reasonably possible following completion of an inspection.
We recognise that vehicle purchasing decisions are often time-sensitive.
However, URBYN places greater importance on producing accurate, objective and professionally reviewed reports than on unnecessary speed.
Where additional review is required to ensure report quality, delivery may reasonably be delayed.
13Technology-Assisted Reporting
URBYN uses proprietary technologies to improve consistency, efficiency and reporting quality.
These technologies assist the inspection process but do not replace professional judgement.
Final inspection findings remain based upon the observations and assessment of URBYN and its authorised inspectors.
14Independent Professional Opinion
URBYN inspections are conducted independently and objectively.
Inspection findings are based solely upon the observable condition of the vehicle at the time of inspection.
URBYN will not alter inspection findings, conclusions or recommendations at the request of buyers, sellers, dealerships or any other interested party.
15Report Validity
Inspection reports represent the observable condition of the vehicle only at the date and time the inspection is completed.
Vehicle condition may change due to use, repairs, accidents, environmental exposure or other factors beyond URBYN's control.
Accordingly, inspection reports are considered current for only the time and date upon which the vehicle has been observed by the inspector.
After this period, URBYN makes no representation that the report accurately reflects the vehicle's current condition.
URBYN offers follow up inspections at reduced rates should the customer wish to have any future concerns addressed prior to delivery of the vehicle to the customer.
16Ownership and Use of Reports
The completed inspection report belongs to the customer who purchased the inspection. To protect the integrity of the inspection reports, URBYN may request the ID / Passport Number of the customer before issuing a completed report.
Customers may share their report at their own discretion.
Reports may not be altered, reproduced for commercial purposes or sold without URBYN's prior written consent.
URBYN reserves the right to apply password protection or other reasonable security measures to electronic inspection reports to safeguard confidential information relating to customers, sellers and vehicles.
17Ownership of Inspection Media
URBYN retains ownership of all photographs, videos, recordings and inspection media created during the inspection process.
Customers receive a licence to use such media as part of their inspection report.
URBYN may use inspection media for:
- •Staff training.
- •Quality assurance.
- •AI system development and improvement.
- •Marketing and promotional purposes,
provided that no customer's personal information is disclosed without consent and the media is not used in a misleading, defamatory or malicious manner.
Personal information will continue to be processed in accordance with POPIA and URBYN's Privacy Policy.
18Limitation of Liability
While URBYN exercises reasonable care, skill and professional judgement in conducting inspections, no inspection can identify every defect or predict future failures.
To the maximum extent permitted by law, URBYN's total liability arising from any inspection shall not exceed the amount paid by the customer for that inspection.
Nothing in these Terms limits any rights that cannot lawfully be excluded under the Consumer Protection Act or any other applicable South African legislation.
19Health and Safety
URBYN reserves the right to refuse, postpone or terminate an inspection where an inspector reasonably believes that continuing would expose any person to danger, unlawful conduct or unacceptable risk.
20Privacy
URBYN processes personal information in accordance with POPIA and its published Privacy Policy.
21Amendments
URBYN may amend these Terms & Conditions from time to time.
The version published on URBYN's website at the time of booking shall apply to that booking unless otherwise required by law.
22Information Provided by Third Parties
Certain information contained within an inspection report may originate from the seller, dealership, vehicle owner or third-party documentation. Unless expressly stated otherwise, URBYN does not independently verify such information and accepts no responsibility for inaccuracies, omissions or misrepresentations made by third parties.
23Fraud
URBYN reserves the right to refuse or terminate any inspection where fraud, attempted fraud, unlawful conduct or deliberate misrepresentation is suspected.
24Force Majeure
URBYN shall not be liable for delays or failure to perform its obligations where such delay or failure arises from circumstances beyond its reasonable control.
25Entire Agreement
These Terms & Conditions, together with URBYN's Privacy Policy, Website Terms & Conditions, Consumer Protection Policy and any written quotation accepted by the customer, constitute the entire agreement between the parties.
26URBYN Commitment
These Terms are intended to promote fairness, transparency and mutual understanding between URBYN and its customers.
